CLASS ACTIONS

The Class Action as an avenue for multiple parties of similar interests to access the courts is relatively new to Newfoundland and Labrador. Since 2002 when this procedure became available to litigants, our solicitors have had an ever increasing exposure to a variety of complex class action proceedings. We currently represent clients in claims involving negligence, products liability, unjust enrichment and potential exposure for oil spill and environmental liability.

Goodland O’Flaherty has by Order of the Newfoundland and Labrador Supreme Court, Trial Division, been selected to represent the proposed class in a current action against the Government of Newfoundland and Labrador. This action is seeking the return of an unconstitutional tax that was levied against persons required to purchase alcohol for sale from the Newfoundland Liquor Licensing Commission. This action is commonly known as the Newfoundland Liquor Licensee Levy Class Action. This action has not yet been certified.
