MARITIME LAW
|
The firm’s practice in the maritime law field has been focused on providing advice and representation to ship owners, charterers, marine insurers, protection and indemnity clubs and marine surveyors on all matters.
In addition, Newfoundland’s geographic location adjacent to international shipping lanes and high seas fisheries has resulted in members of our firm having provided specialized advice on jurisdictional issues, international law and extradition proceedings involving crimes on the high seas.
We have recently acted on the following significant matters in the maritime law field:
Acting for a leading publicly traded Canadian intermodel transportation company in the 2008 acquisition and mortgage of three vessels.
Acting for an authorized representative of a small fishing vessel on the successful appeal in 2011 of an administrative penalty assessed by the Minister of Transport.
Acting for a marine architect and marine consultants on an application for leave to the Supreme Court of Canada in 2011 on a significant maritime law issue.
Acting for the master of a ferry in the successful defence of a 2011 prosecution under the Canada Shipping Act, 2001 arising from a collision.
Acting for an inter-provincial transportation company on the 2011 refinancing and mortgage of vessels.
